Agreement

These Terms and Conditions ("Terms") are a binding agreement between you and M.R. Dula Enterprise, LLC ("Company," "we," "us") for your use of the CW Fast website and application (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

CW Fast provides tools to learn Morse code by ear, including drills, progress tracking, and related educational content. We may change, suspend, or discontinue features at any time. We strive for accuracy but do not guarantee that content is error-free or suitable for every licensing or on-air requirement in your country.

Eligibility and accounts

You must be old enough to form a binding contract where you live and not barred from using the Service under applicable law. You are responsible for your account credentials and for all activity under your account. Sign-in is provided through Clerk; their terms also apply to authentication services.

Acceptable use

You agree not to:

• Use the Service unlawfully or to harm others
• Attempt to gain unauthorized access to systems, accounts, or data
• Interfere with or disrupt the Service (including automated abuse)
• Reverse engineer or scrape the Service except as permitted by law
• Misrepresent your identity or affiliation

We may suspend or terminate access if we reasonably believe you have violated these Terms or pose a risk to the Service or others.

Intellectual property

The Service, including software, design, text, audio patterns, and branding, is owned by the Company or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial learning purposes in accordance with these Terms.

Your data

You retain rights in content you submit (for example, typed drill responses). You grant us a license to host, process, and display that content as needed to operate the Service. Our use of personal information is described in our Privacy Policy.

Fees

Some features may be offered free of charge today; we may introduce paid plans or limits in the future. If we charge fees, we will present applicable terms before you are billed.

Termination

You may stop using the Service at any time. We may terminate or suspend your access with or without notice if you breach these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ends; provisions that by their nature should survive (including disclaimers and limitations of liability) will survive.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CW FAST IS AN EDUCATIONAL TOOL, NOT PROFESSIONAL RADIO, LEGAL, OR SAFETY ADVICE. YOU ARE RESPONSIBLE FOR COMPLYING WITH AMATEUR RADIO RULES AND SAFE OPERATING PRACTICES IN YOUR JURISDICTION.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

Indemnification

You will defend, indemnify, and hold harmless the Company and its affiliates from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. The federal and state courts located in Delaware will have exclusive jurisdiction over disputes arising from these Terms or the Service, except where mandatory consumer protection laws in your country require otherwise.

General

These Terms, together with the Privacy Policy, are the entire agreement between you and the Company regarding the Service. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

Changes

We may modify these Terms from time to time. We will post the updated Terms with a new "Last updated" date. Continued use after changes become effective constitutes acceptance of the revised Terms where permitted by law.
